Abstract  アメリカ合衆国においては,障害者教育改善法(IDEA)に基づいて,障害のある子どもの教育的な決定に関 する親の参加が保障されている。一方で,その具体的な運用にあたっては,親と学校との対立が生み出されており, 訴訟に発展するケースもみられている。本稿は,IDEA によって保護されている親の権利をめぐって,親の過失 を認定したオハイオ州北部地区連邦地方裁判所による判決(Horen v. Toledo School District., 113 LPR 48072 (N.D. Ohio 2013))を中心にとりあげ,とくに個別教育計画の立案ミーティングにおける親の参加の観点から,対立の 構造と論点を整理した。連邦地方裁判所は親と学校区とのやりとりの分析から,「これ以上露骨な参加の拒否は 容易に想像できない」と述べ,学校区からの働きかけに対して「やめてくれ」と拒絶した親の責任を全面的に認 定した。最後に,本裁判の結果をふまえ,今後における親と学校との協力体制の重要性を指摘した。

Abstract 本稿は,学校が障害のある子どもに保障すべき教育成果の水準について,米国連邦最高裁判所が示した画期的な判決(Endrew F. v. Douglas County SD , 2017)の論点を捉えることにより,今後のインクルーシブ教育のあり方の検討に必要な基礎資料を提供することを目的とした。米国では障害者教育法(IDEA)により,障害のある子どもに対する「無償で適切な公教育」(FAPE)が保障されている。従来,FAPEが求める教育成果の水準に関しては,1980年代の最高裁判所判決(Board of Educ. v. Rowley , 1982)が大きな影響を与えてきた。つまり,FAPEの要求は「最小限を満たすもの」であれば足りると解釈されてきた。しかしながら,Endrew 裁判によって,実質的な意味のある教育成果が求められることが判示された。今後,本裁判を契機に,障害のある子どもに対する教育の成果がこれまで以上に大きな議論となることも予想できる。
Abstract Alternative The purpose of this brief note was to understand the whole context of the "Endrew F. v. Douglas County School District " (2017) in the U.S. Supreme Court. The Individuals with Disabilities Education Act (IDEA) requires to guarantee a free appropriate public education (FAPE) for students with disabilities. In the "Board of Education of the Hendrick Hudson Central School District v. Rowley " (1982), the U.S. Supreme Court was rejected requirement to maximize educational potential of student. This decision has been quoted for a long time in the lower courts. However, new standard in the Andrew case was judged. We provides a summary of important legal contents.

Abstract 本研究は、障害ある人の造形美術活動支援を通して、障害者が生きがいを持ち、自立できることを目指している。その手段として、各種ワークショップを開催するために、絵画、彫刻、書道など多様な分野の人材を結集し、ふんだんな材料を提供し、ワークショップを行う。障害がある、なしにかかわらず、参加できる新しい障害者芸術の展開を図る。障害者の造形美術活動を推し進めるためにボランティア組織を確立し、造形美術活動を通して、ノーマライゼーションを推進する。
Abstract Alternative As for this research, the disabled person had definite aim in life through a disabled person's plastic art activity support, and it aims at that it can become independent. As the means, in order to hold various workshops, the talented people of various fields, such as pictures, sculpture, and calligraphy, are concentrated, plenty of material is offered, and workshop is held. Deployment of the new disabled person art which is not concerned nothing but can patricipate whth obstacles is aimed at.

Title Alternative A practice for nursing students to understand a patient through his book of struggling against disabilities due to cervical injury

Abstract Thirty-nine nursing students in their third year were required to read a book written by a male patient struggling against disabilities due to cervical injury for nine years in the hospital and to report their impressions during their clinical practice. The contents of their reports were classified to four categories, that is understanding, helping care, nursing attitude for the patients and problems for the students themselves. The most frequent descriptions were made about understanding the patients, especially about his affliction caused by psychological feeling of his handicaps. The subsequent frequent descriptions were concerning the care of the patients such as importance to improve his residual function and necessity of team work care for the purpose. Doscriptions about nursing attitude were followed. This method was helpful for understanding the situation of a patient and for practicing nursing processes to respond to the patient's needs.
